A probation summary is written by the department. A case-note export is written by the software. If the two disagree, only the export is evidence.
The Steps
- 1Write to the supervising probation department
Identify yourself, the case number, the supervision period, and the officers assigned.
- 2Ask for the native export
Request the complete case-note history in native or machine-readable export format, including every entry, its author, its creation timestamp, and any modification history.
- 3Request contact documentation separately
Call logs, email records, appointment records, and assignment history. These establish what contact was actually attempted, which is the usual dispute in a failure-to-report allegation.
- 4If a transfer or courtesy supervision is involved, request the transmission
Ask for the exact contents of what was transmitted between jurisdictions, the transmission date, and the export log. This is where exculpatory documents get left behind.
- 5Request every drug-test document
Collection records, laboratory reports, confirmation testing, and any written clearance or prescription verification. A clearance letter is worthless if it never travelled with the file.
- 6If a case is pending, do it through discovery too
A records request and a discovery request are different levers. Use both.
